Disagreement among the opponents as to whether a man may have intercourse with his lewd slaves

Question:
Do scholars among our opponents allow the intercourse of prostituted slaves?
Answer:
Ibn Quddamah Al-Maqdisi writes:
وإذا علم الرجل من جاريته الفجور فقال أحمد لا يطؤها لعلها تلحق به ولدا ليس منه قال ابن مسعود أكره أن أطأ أمتي وقد بغت وروى مالك عن يحيى بن سعيد عن سعيد بن المسيب أنه كان ينهى أن يطأ الرجل أمته وفي بطنها ولد جنين لغيره قال ابن عبد البر هذا مجمع على تحريمه وكان ابن عباس يرخص في وطء الأمة الفاجرة وروي ذلك عن سعيد بن المسيب ولعل من كره ذلك كرهه قبل الاستبراء أو إذا لم يحصنها ويمنعها من الفجور، ومن أباحه بعدهما فيكون القولان متفقين. والله تعالى أعلم
“If a man knew of his maid’s fornication, thus said Imam Ahmad: “He does not enter into her, for she may bring him a child who is not his.” Abdullah Ibn Mas’ud said: “I hate to enter my slave when she is fornicating.” Imam Malik narrated from Yahya Ibn Sa’id that Sa’id Ibn Al-Musayyib prohibited a man from entering his slave who carries another man’s child in her womb. Ibn Abd Al-Barr said: “There is a consensus on the prohibition of this.” Abdullah Ibn Abbas allowed to penetrate a slave who is a prostitute and this is narrated from Sa’id Ibn Al-Musayyib and perhaps the scorn (Makruh) refers to the time before the delivery and the cleanliness after the pregnancy, if he did not restrain her and forbade her to fornicate and whoever allowed it after that, the two statements thereafter agreed with each other, but God knows best.” [Al-Mughni, volume 9, page 566]
