Temporary partnership without questioning about marital status

Mufaddal Ibn Umar reported that he said to Imam As-Sadiq (a.): “My Lord, now the temporary partnership.” He said: “The temporary partnership is allowed without restrictions and its confirmation is the Word of God.” He then continued with an extensive speech until Mufaddal Ibn Umar said: “My Lord, now what are the conditions for a temporary partnership?” He said: “O Mufaddal, it has seventy conditions. Whoever violated one of them, did wrong to himself.” I said: “My Lord, you have commanded us to enter into a temporary partnership with neither an unchaste woman nor a woman famous for immoralities nor an insane one, and that we should invite her to obscenity (sexual intercourse) instead of the temporary partnership and that if she consents, it is forbidden to enter into a temporary partnership with her and that we ask if she is single or wether she has a partner or is pregnant or is waiting (period) and if she has any of these three, she is not allowed and if she is free from it, then one says to her “Enter into a temporary partnership with me according to the scripture of God and the custom of His prophet, a union, not fornication, for a fixed term, for a known gift – and that it lasts a moment or a day or two days or a month or a year or less than that or more and that the gift is that, on which the two agreed, a ring hoop or sandal strap or a piece of date, up to what is beyond that in silver coins or gold coins, or a submission with which she agrees – on the basis that you do not inherit me and i do not inherit you and on the basis that i command where the ejaculation goes. I do it from where i desire. It is obligatory upon you to discharge forty-five days or one menstruation. If she says: “Yes.” And then you repeat the statement again, you will complete the union. If now you and she wish an increase in the time limit, extend it.” [Al-Hada’iq of Al-Bahrani, Volume 24, Page 148, Hadith 1]

يوسف بن أحمد عن محمد باقر بن محمد تقي عن المفضل بن عمر عن جعفر بن محمد الصادق عليهما السلام قال: مولاي فالمتعة قال: المتعة حلال طلق والشهادة فيها قول الله عز وجل، ثم ساق كلاما طويلا إلى أن قال: قال المفضل: يا مولاي فما شرائط المتعة قال: يا مفضل لها سبعون شرطا من خالف منها شرطا واحدا ظلم نفسه، قال قلت: يا سيدي قد أمرتمونا أن لا نتمتع ببغية ولا مشهورة بفساد ولا مجنونة، وأن ندعو المتعة إلى الفاحشة فإن أجابت فقد حرم الاستمتاع بها، وأن نسأل أفارغة أم مشغولة ببعل أو حمل أو عدة، فإن شغلت بواحدة من الثلاث فلا تحل، وإن خلت فيقول لها: متعيني نفسك على كتاب الله عز وجل وسنة نبية صلى الله عليه وآله نكاحا غير سفاح، أجلا معلوما بأجرة معلومة وهي ساعة أو يوم أو يومان أو شهر أو سنة أو ما دون ذلك أو أكثر والأجرة ما تراضيا عليه من حلقة خاتم أو شسع نعل أو شق تمرة إلى فوق ذلك من الدراهم والدنانير أو عرض ترضى به على أن لا ترثيني ولا أرثك، وعلى أن الماء لي أضعه منك حيث أشاء، عليك الاستبراء خمسة وأربعين يوما أو محيضا واحدا، فإذا قالت، نعم أعدت القول ثانية وعقدت النكاح فإن أحببت وأحبت هي الاستزادة في الأجل زدتما

Mihran Ibn Muhammad reported about Imam As-Sadiq (a.) from some companions: “Someone said to him: “Someone entered into a temporary partnership with a woman.” Thus one said to him: “She has a partner.” After this he asked her.” Then Abu Abdillah (As-Sadiq) said: “And why did he ask her?” [Al-Hada’iq of Al-Bahrani, Volume 24, Page 115, Hadith 4]

Fadl, the client of Muhammad Ibn Rashid, reported about Imam As-Sadiq (a.): “I said: ‘I entered into a temporary partnership with a woman. This gave me the idea that she might have a partner. So i asked about it and found out that she has a partner.” He said: “And why did you ask about it?” [Al-Hada’iq of Al-Bahrani, Volume 24, Page 115, Hadith 3]

يوسف بن أحمد عن محمد بن الحسن عن فضل مولى محمد بن راشد عن جعفر بن محمد الصادق عليهما السلام قال قلت: إني تزوجت امرأة متعة فوقع في نفسي أن لها زوجا ففتشت عن ذلك فوجدت لها زوجا قال: ولم فتشت

Yusuf Ibn Ahmad reported that Imam Ar-Rida (a. ) said: “The second type is a union without witnesses and without inheritance and this is the union through a temporary partnership with its provisions and it consists in asking a woman if she is single or attached to a partner or a waiting period or pregnancy and if she is free of it, one says to her: “Enter into a temporary partnership with me according to the scripture of God and the custom of the messenger of God, a union, not fornication, so and so for so and so – and make clear the gift and period – on the basis that you will not inherit me and i will not inherit you, on the basis that i will put the ejaculate where i desire and on the basis that when the period is completed, you will have a waiting period of forty-five days. ” When you come to the end, you say to her: “Enter into a temporary partnership with me. And you repeat to her all the regulations, because the first statement is a request and every regulation before the union is null and void and the matter is concluded only by the second statement. The second time she says: “Yes.” If the gift is given to her or what is present of it and the rest of it is your debt and you have been allowed to copulate with her.” [Al-Hada’iq of Al-Bahrani, Volume 24, pages 147 – 148, Hadith 2, Hadith 5]

يوسف بن أحمد عن علي بن موسى الرضا عليهما السلام قال: والوجه الثاني نكاح بغير شهود ولا ميراث وهو نكاح المتعة بشروطها وهي أن تسأل المرأة فارغة هي أم مشغولة بزوج أو بعدة أو بحمل وإذا كانت خالية من ذلك قال لها تمتعيني نفسك على كتاب الله وسنة رسول الله صلى الله عليه وآله نكاح غير سفاح كذا وكذا بكذا وكذا وبين المهر والأجل على أن لا ترثيني ولا أرثك وعلى أن الماء أضعه حيث أشاء، وعلى أن الأجل إذا انقضى كان عليك عدة خمسة وأربعين يوما فإذا أتممت قلت لها متعيني نفسك وتعيد جميع الشروط عليها لأن القول الأول خطبة وكل شرط قبل النكاح فاسد وإنما ينعقد الأمر بالقول الثاني فإذا قالت في الثاني نعم دفع إليها المهر أو ما حضر منه وكان ما بقي دينا عليك وقد حل لك وطؤها

Yunus Ibn Abdi r-Rahman reported about Imam Ar-Rida (a.): “I said: “A woman enters into a temporary partnership. So her term expires. After that she enters into a partnership with another before her waiting period has expired.” He said: “And what makes you worry? The sin of this is only her concern.” [Al-Hada’iq of Al-Bahrani, Volume 24, Page 115, Hadith 2]

يوسف بن أحمد عن محمد بن علي عن يونس بن عبد الرحمن عن علي بن موسى الرضا عليهما السلام قال قلت: المرأة تتزوج متعة فينقضي شرطها فتتزوج رجلا آخر قبل أن تنقضي عدتها قال: وما عليك إنما إثم ذلك عليها

Abu Mariam reported on Imam Al-Baqir (a.): “He was asked about the temporary partnership, whereupon he said: “The temporary partnership today is not like it was in the past. On those days they could be relied upon and today they cannot be relied upon. So ask about them.” Yusuf Al-Bahrani writes: “Part of this is that it is better for one to ask about their current situation when they cannot be relied upon.” [Al-Hada’iq of Al-Bahrani, Volume 24, Page 114, Hadith 4]
